Hi,
I am on H1B visa. I have completed my last project and now on bench from mid of Nov'09. My employer (desi consultant) had asked me to send an Application for Unpaid leave so that he can maintain my H1b status. I sent a vacation letter for 2 Weeks and for which he has not paid me a bench salary. Now again he is asking me to submit another letter of unpaid vacation until the date I will get my next project.
My dilemma is how long should I entertain such requests from him and if in case I refuse to go on vacation what are my chances of being laid-off?
Will Employer loose any of his eligibility like no new H1/GC petition for short future up on lay off?

My firm recently extended my H-3 training visa until June of 2008. The old one ran out at the beginning of November 2007 and I was told by my lawyer that I could stay in the country, that my status would be okay.
However, I left the country for a personal emergency and didn't have time to go to the consulate while I was away for a new stamp. The current visa in my passport had expired by this point.
Upon my re-entry to the country I filled out the green I-94w form.
What do I need to do to get my correct status? have I done anything to affect my H3 status??
Any advice greatly appreciated!!!

I think if she didn't indicate that she intended to do CP in her I-140, but rather indicated she intended to do AOS in the US, then it will be a pain in the neck to switch to CP

I posted this message earlier in some other thread. Actually my questions were irrelevant to the thread I added the message on. Hence, creating a new thread.
I have couple of questions regarding GC filing for future employment.
a. Is it legal to work for company B if one is working for company A and company A has already filed LC?
b. Any danger of getting audit because of multiple LCs?

Hi Folks,
Can I travel on a valid / approved AP when my H1 Extension is in progress. This is my
situation:
Valid AP in Hand valid till next year.
H1B expiring 6/20/2011
H1B extension applied on 4/7/11 have rcpt notice.
My questions are this:
1.) When I enter US back in with my AP in mid July will that impact my H1B extension in any way.
2.) Without any EAD will I be Jeapordizing my AOS in any way.
I will be continuing to work with the same employer who is the sponsor of my current
I485.
Request your thoughts and inputs on this situation. Appreciate any replies/advices you may have.

Since I am a canadian citizen, I do not require a visa for US and hence I don't have a H1B visa stamped on my passport.
Since you know this point, I am sure the American Visa Officer working in various consulates, too, would know this. If not, send a copy of the law that says "Canadian citizens do not need Visa to enter US".

Your I-485 will not go forward unti they receive the 140 approval.
I-485 petition will be undated automatically as soon as the corresponding I-140 is approved.
As far as I know, you don't have to inform uscis about your I-140 approval.

my current employer filed for my labor in march 2005, got approved in march 2007, filed I-140 in April 2005,and while I-140 was pending filed I-485 in july fiasco. In sep-2007 got intent to deny of I-140 based on A2P(ability to pay), employer filed M.T.R in October 2007. I have my fingered crossed looking at the financial statment from employer for the year 2005. chances are the MTR will be denied too. Now I have a new job offer from another employer who is willing to do new H1b for me and may be a labor petition too. the question is I want to see what comes out of the current MTR. Here is the question;
1/- if I tell the current employer to contine the process(which I dont think he will have problem with) and join the job on h1b will my I-485 status be changed or will it effects the current process?
2/- I am currently runnig on sixth year of h1b and my current visa expires in 2010 bades on the pending process with current employer. if I join the new employer on h1b what will be the H1b status will be?

The President has started revealing his plans on immigration for the next year. It sounds like he's planning on trying a do-over with Congress and attempting again to get a comprehensive immigration bill passed. He'll make the case for this in his State of the Union Address. I'm happy the President is still interested in working for change, I sincerely hope he is not making passing a reform bill his SOLE strategy. I am on L1B visa from Apr 2008. I have my PERM and I140 approved.
I got a email from my attorney stating that they want to file my H1B petition this year so that they can keep on renewing my H1b as long as my company wants.
Suppose they file H1B COS petition then my status will automatically change on Oct 1 2010.
I am planning a vacation to India in November 2010, what are the options with me when come back to US.
- Do i have to stamp the H1B visa OR
- I can still come back on my existing L1B visa ???
Please suggest

My I-140 approved in Aug 2007,My employer has withdrawn the I-140 in july but still it is approved in Aug 2007,Now my employer is agreed and want to sent the letter to USCIS not to withdrawn this I-140,As I am in Canada so they are planning to file the I-824 for me for Consular processing,so please advice do they need to file the new I-140 for me for Consular processing as they sent the withdrawn letter to uscis or is it ok for them to sent the letter again to uscis and telling them not to withdrawn this case and file I-824 for CP.Please advice!!!!!!

Marco Rubio has a challenge. He needs to appeal to conservatives in order to drum up enough votes to defeat popular Governor Charlie Crist in next year's Florida GOP primary. Then he has to run back to the middle to appeal to an increasingly liberal Florida general electorate. When it comes to immigration, he needs to come off as tough on illegally present workers.
