    Hi,
    I am an architect, on OPT right now but do not have a job.I am looking for one, and hope to get one by April. I am looking for H1 sponsorships, and as is well known, the visa has to be applied by April 1.

    However it is difficult to find a job by then AND get my employer to sponsor me by April 1.
    Does anyone know how long will the window to file H1s be open this year?

    I am guessing that this year, the number of H1s filed willbe lesser than the 65000 limit....do you think that the window will be open longer?(I want to buy more time to apply)

    Conservatives Launch Caucus (http://www.rollcall.com/issues/53_52/news/20766-1.html) By John Stanton | ROLL CALL STAFF, October 31, 2007

    Frustrated by what they see as a party gone astray, a group of House and Senate conservatives led by Sen. Jim DeMint (R-S.C.) and Rep. Jeb Hensarling (R-Texas) today will announce a new bicameral caucus aimed at returning fiscal restraint, ethics and national defense to the fore of the GOP's philosophical and policy platforms.

    The group - which in addition to DeMint and Hensarling is made up of Sen. Tom Coburn (R-Okla.), Rep. John Shadegg (R-Ariz.), Rep. Paul Ryan (R-Wis.), Rep. Tom Price (R-Ga.) and Rep. John Campbell (R-Calif.) - will officially announce the creation of their new caucus - dubbed Reagan21. They also will unveil their "statement of policy commitment," which includes 10 key positions on issues ranging from Congressional earmarks to health care reform.

    While participants are billing the new caucus as a complement to the leadership teams in place in the House and Senate, Republicans familiar with the project acknowledge that to a certain degree it is a challenge to Senate Minority Leader Mitch McConnell (R-Ky.) and House Minority Leader John Boehner (R-Ohio), because implicitly the call for a new direction is a rejection of the course they have steered along with President Bush.

    "When you're saying, 'Here's the vision of what the party should be,' you're saying the vision isn't there right now," said a House Republican not directly involved with the effort.

    A second Republican agreed, arguing that a more broad change in how the party runs is needed.

    "Whenever there's a vacuum in elected or political leadership, there's a need to fill it. When you have leadership positions not resulting in leadership, people will go elsewhere," the second Republican said, adding the problems of the party go far beyond simple messaging conflicts.

    "It's a fight for [the GOP's] soul, not just a superficial divide. There are people who believe it's the job of Republican Members to come here and send money home to their states and to expand government. And that's just not what rank-and-file party members want."

    Today's announcement of the group's principles for reform of the Republican Party are the first in a series of steps that the caucus will take over the next several months. Members are in the process of setting up independent outside institutions - similar to the Congressional Black Caucus Foundation - to support their activities, and they will have a Web site up and running in the next few weeks.

    Although details of those plans were unclear at press time Tuesday, one member of the group said the caucus will use the foundation as a semi-independent apparatus to communicate with Republicans outside Washington, D.C., as well as the general public.

    Although members of the group declined to comment on the caucus on the record, one Member involved said the lawmakers believe the GOP's elected leaders have strayed from the party's traditional fiscal conservative roots.

    "A few of us here are trying to change the culture" of the GOP, the lawmaker said, adding that "the core values of the Republican Party are not being adhered to by the party inside Congress. But there's a yearning for it outside the Beltway."

    According to Republicans familiar with the effort, it arose from meetings between DeMint, who chairs the Republican Steering Committee in the Senate, and Hensarling, who chairs the Republican Study Committee in the House. Both organizations are the hub for conservative efforts in the chambers, and following the disastrous 2006 election, DeMint and Hensarling began holding meetings in an effort to better coordinate their efforts.

    Eventually, the two began to bring other lawmakers into these Member-only meetings. Following months of discussion, the group decided to start the caucus, choosing a name that would invoke the core fiscal principles of former President Ronald Reagan for the 21st century.

    The principles - which new members will be required to make a pledge to follow and which will be the centerpiece of the group's legislative and public outreach efforts - cover a wide variety of issues. For instance, members of the caucus will be required to foreswear asking for any new earmarks in legislation. The principles also call for reforms to the tax code and entitlement programs, including the implementation of personal "ownership" of retirement security and health care decisions, according to a copy of a document obtained by Roll Call. Members of the caucus also will support expansion of intelligence and other national defense programs, as well as an aggressive border security approach to immigration.

    While all of the members of the group would likely fall under the broad rubric of "social conservatives," the principles steer clear of issues like abortion or gay marriage. According to those involved in the effort, members of Reagan21, according to one, have decided that while those issues are important to them, they have decided to "focus on the fiscal policy issues that I think really killed us last year."

    Republicans privately also applauded the decision to stay with traditional fiscal issues rather than expand the group's focus into social topics. One source noted that while most base Republican voters are fierce social conservatives, many independent voters and disaffected Democrats - who agree with the GOP on fiscal issues and ethics - are turned off by the party's heavy tilt toward its social wing.

    According to GOP aides, the group has operated under strict confidentiality rules as it has hashed out how it will operate and what its mission should be - so much so that staff continue to have only a sketchy idea of what their bosses are envisioning. Additionally, the members of the group have agreed to not tip their hand to either Boehner or McConnell before today's news conference, although they have begun reaching out to like-minded Members in the House and Senate to join the group.

    The formation of the caucus is the latest in a series of breaks between conservatives, particularly in the Senate, and the party's traditional power centers this year. DeMint and Coburn have openly and repeatedly attacked "Old Bulls" in the party like Sen. Ted Stevens (R-Alaska) for their use of earmarks. Additionally, conservatives openly broke with their leaders this spring over the immigration bill.

    The Reagan21 member cautioned that the caucus's critique of current GOP positions should not be seen as members "tak[ing] a swipe at anybody" in leadership positions. "They've got a tough job and it's hard to get your arms around the whole party" in a way that could facilitate reform, the lawmaker explained, adding that Reagan21 participants see themselves as "the conscience of the Republican Party here" in Washington.

    But reform will be key if Republicans are to avoid further electoral loses next year, this member said.

    "Unless the Republicans get together and define themselves we're going to get caught in fog. ... I don't want to be Democrat-lite," the lawmaker said, adding that the group hopes to attract Members who have long been fiscal conservatives as well as new recruits. Reagan21 hopes "that a lot of these Republicans who like to think they can have it both ways - go home and talk like conservatives but come here and vote for whatever they want - will be forced to come to our side. We can't continue to allow a few people in our party continue to pervert what we are about."

    Hi for IRS n Tax purposes you are a resident alien (even though you may be a non-immigrant h1b or using EAD) that is different.

    This form is not applicable to you. Tell the credit union that you are resident alien and then they will understand.

    No need to fill this form.

    Instead you need to apply for TIN (Tax Payer Identification Number) Form W-9 for your wife and get a TIN and use that TIN while adding as a dependent.

    You can either file the TIN yourself or go to HnR block or some other service. Usually they file for TIN while filing tax return...

    I-140/I-485 concurrent will be filed in first week of august 2007.

    Which fee will be applied in this case ? New August filing fee or same July filing fee?

    USCIS FAQ are confusing for this scenerio. I am sure lot of people are in the same boat. Kindly let me know what is the right filing fee for this scenerio.

    WASHINGTON (AP) -- Under a portrait of George Washington and a sign proclaiming "A New Direction," Democratic lawmakers boasted of their accomplishments their first five months running Congress.

    Their press release covered two pages.

    Yet most people might be excused for hardly noticing, except maybe those who are paid the minimum wage or who live in hurricane-ravaged areas.

    Upon taking control in January, Democrats led efforts to increase the minimum wage for the first time in a decade and to force modest spending increases in hurricane and drought relief, children's health care and a few other areas.

    Beyond that, the majority party has found it difficult or impossible to redirect federal policies, thwarted by a veto-wielding Republican president whose congressional allies hold nearly half the Senate seats and a significant portion of the House.

    To the frustration of their liberal base, Democrats have been unable to mandate a timetable for withdrawing troops from Iraq. Nor have they found a way to boost federal support for embryonic stem cell research, rewrite tax and spending priorities or force the removal of an embattled attorney general.

    Their promises to reduce student loan rates, overhaul lobbying practices and put in place recommendations of the Sept. 11 commission are works in progress, at best.

    They have largely abandoned their push to allow the government to negotiate prescription drug prices for the Medicare program in the face of Bush's opposition.

    Democratic voters might be disappointed, but they should not be surprised, say congressional scholars and political strategists. While Democrats can set the legislative agenda and investigate the Bush administration, they "don't have the power" to determine the results, said Ronald Walters, a political scientist at the University of Maryland.

    Lacking the two-thirds majorities needed in both chambers to override a veto, Democrats must make the most of their abilities to pressure the White House, hold oversight hearings and drive the toughest bargains they can, Walters said.

    "Democrats are in a negotiating framework consistently," Walters said. "That's where they will be as long as the president has a veto pen."

    Even the Democrats' most clear-cut legislative victory - raising the minimum wage to $7.25 from the current $5.15 over three years - has questionable impact.

    Only a small fraction of workers earns the minimum wage, and Democrats had to buy Republican support with $4.84 billion in new tax cuts for small businesses.

    Still, raising the minimum wage has value as a fairness issue, some Democrats say. They urge the party's constituents to welcome such symbolic and incremental victories in a divided government.

    Having Democrats control the House and Senate "makes a huge difference, given the set of challenges the country faces and given that so little was done in the last Congress," said former Democratic Rep. Tim Roemer of Indiana, a member of the Sept. 11 commission.

    Democrats have shifted the debate in important ways that may lead to policy changes in this Congress or the next, he said.

    On Iraq, Roemer said "it's no longer a question of if" the United States will adopt a withdrawal timeline, only a question of when.

    Citing global warming, he said Congress is no longer seriously debating whether the problem exists - as it did last year under Republican control- but considering how to address it.

    Veteran Democrats say party supporters must understand that legislative victories often will come at the margins of major issues.

    Consider children's health care, a Democratic campaign priority. Congress in May added an immediate $650 million to the State Children's Health Insurance Program. Budget bills for 2008 call for an extra $50 billion, but the effort must survive the appropriations process, and Bush has pledged to veto measures he considers too costly.

    Democratic leaders hailed the increases for the children's program, even as they acknowledged the proposed new spending would hardly fill the health insurance gaps.

    The change in control of Congress is important, "but what it doesn't mean is the Democrats can impose their will," said Florida Democrat Bob Graham, a former senator, governor and presidential candidate. "It does mean the Democrats can set the agenda and force issues" to the forefront, such as a minimum wage raise that Republicans had blocked for years.

    Perhaps the most dramatic change in Congress involves the rising number and intensity of hearings into alleged misdoings by the administration.

    Subjects of investigations include contracting practices in Iraq; the use of prewar intelligence; the firings of federal prosecutors; the use of warrantless wiretaps; the friendly fire death in Afghanistan of Army Cpl. Pat Tillman; and the use of political e-mail accounts by White House officials.

    The "amazing lack of oversight of White House programs and initiatives" that existed under GOP-controlled congresses has ended, Walters said.

    Some Democratic activists say it is important to remind voters that Bush and congressional Republicans play a central role in legislative impasses.

    "It's hard to see a lot getting done," said lobbyist Steve Elmendorf, a former top House Democratic aide. "I don't know if Bush has the juice to deliver the Republican votes he needs" even on issues the president strongly backs, such as a proposed overhaul of immigration laws, he said.

    At the end of this Congress, Elmendorf predicted, Democrats will have "a record of fiscal responsibility" and voters will understand that they could not overcome Bush's resistance on matters such as embryonic stem cell research.

    As for the Iraq war, he said, even if Democrats can't force a withdrawal deadline, "the message that Americans are getting is: Democrats want change, Republicans don't."

    I received a RFE of my I485, and was asked to declare my self-employment since Dec,31, 2006. I have been engaged in Market America Direct Sell business part-time since August 26, 2005, and have claimed buinsess lost in my tax return since 2005. In 2006, I got a 1099 form that showed $600 income from Market America. After that I didn't have any income from the business.

    My question is if I am self-employment. If so, do you have any way to resolve this issue?

    My last entry into USA is 07/05/2008, but the I-94 was not replaced at Niagara Falls port. The last entry date on my passport is still Dec, 31, 2006.

    My EAD start date is 7/31/2008.

    I am looking for an Attorney who is an expert at this case to reply my RFE and resolve my pronblem.

    Hi,
    I am student on OPT extn working for an Non Profit Organisation ( non everified) , Since 2 months, I Know i should not work for non everfied company on OPT Extension, So i asked my company to do H1 asap, since workiing for non everified aslso considered as unemployed, But i am aware that in entire OPT we can unemployed for total 120 days.

    My company is an Non Profit Organisation & dont have relatioship with any educational institues or research org.

    Is my company eligible for H1 cap exempt, so that i can keep my start date as approval of H1? so i wont fall out of status since my H1 starts as the days of approval............or I need to wait until oct 1, 2010,

    Even if i start at oct 1,2010, Will it affect my green card processing, since I worked for non everified around 6 months...........

    I have an Andvance Parole valid till Feb'10 end. However right now am in India and wish to stay back even after the AP expiry. In this scenario is it good to apply for renewal AP from India or is it advisable to return back to US and then apply for AP?

    Does any one provide how much time it takes for the renewal if I apply for AP from India. Do I need to give the India address for delivery? I have some one in US who can recieve the AP by mail and can send it by post to India. Is this an advisable?
